PREAMBLE
These general conditions of sale set out the terms of the contract entered into between the Client and Dune-Parapente during the sale of paragliding gift vouchers. Exclusivement commercialisés par l’intermédiaire de son site Internet (http://www.parapentedunedupyla.com ) ainsi que les règles d’utilisation du bon cadeau par le bénéficiaire.

ARTICLE 1 Purpose
These General Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of paragliding gift vouchers offered by the Seller and are an integral part of the Contract between the Buyer and the Seller.

The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The applicable T&Cs are those in effect on the date of payment (or the first payment in the case of multiple payments) of the order.

The Client declares that he is able to legally contract under French law or validly represent the natural or legal person for whom he is contracting.
The buyer, having taken note of the services offered, their characteristics and their constraints, has under his sole responsibility and according to his needs as he has previously determined them before any order, made his choice on the services which are the subject of his order. In addition, the buyer alone knowing the physical conditions of the beneficiary of the gift voucher, is the sole judge of the compatibility of the requested services with the physical conditions of the beneficiary.
ARTICLE 2 Prices
The prices are exempt from value added tax (VAT). These are sports education services.
To pay for his gift voucher order, the buyer can pay by credit card.
Application fees
An administration fee of 80 euros including tax is applied to all orders for Baptism gift vouchers and this fixed fee corresponds to the processing of the order and the cost of organizing appointment requests.
In the event of reimbursement for a duly justified exceptional reason of a gift voucher (illness, death), these fixed costs remain acquired by Dune-Parapente.
The Company reserves the right to modify its prices at any time for the future.
ARTICLE 3 Conclusion of the online contract

ARTICLE 4 Products and services

The contractual information is presented in detail and in French. The validity period of the gift voucher offer and their prices are specified on the Company's website in these general terms and conditions of sale.
ARTICLE 5 Conformity
Les prestations proposées respectent les dispositions de l’article L.411-1 du Code de la consommation,
ARTICLE 6 Retention of title clause
The products offered remain the property of the Company until full payment of the price.
ARTICLE 7: Payment
Payment is due immediately upon ordering.
The Customer can pay by payment card.
Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa).
Secure online payment by credit card is carried out by our payment service provider. The information transmitted is encrypted according to the rules of the art and cannot be read during transport on the network.
Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately terminated by operation of law and the order canceled.
ARTICLE 8 Withdrawal period
Concerning only the sale of gift vouchers, and in accordance with article L.221-18 of the Consumer Code, the consumer has a period of 14 working days from the date of delivery of his order, to return the voucher that is not suitable and request an exchange or refund without penalty.
ARTICLE 9 Period of validity
La durée de validité du bon cadeau est d’un an à compter de la date d’achat du bon, dans les limites des dates d’ouverture qui sont de début Avril à fin Septembre de chaque année. Néanmoins si le bénéficiaire a fait 3 tentatives de réservation et que ses rendez-vous se sont vus annulés par le vendeur, pour des problèmes de météo, l’utilisation du bon sera exceptionnellement prolongée au maximum d’une année civile à compter de la date de fin de validité initiale, indiqué sur le bon.
Pour l’application de l’alinéa ci-dessus relatif au renouvellement d’un an, seules les tentatives de réservations effectuées par le Client sur des dates sélectionnées et validées sur le site seront prises en considération et retenues s’il y avait annulation de la part du vendeur.
A l’issue de l’année de renouvellement et quelque soit la raison pour laquelle le vol n’a pas pu être réalisé, la validité du bon expire et en conséquence le bon n’est plus utilisable, ni remboursable.
Please note that baptisms take place between April and September.
Examples:
– Your gift voucher is purchased on January 15, 2022, you can take your flight during the opening period, i.e. from April to the end of September 2022; and if 3 reservations during this period from April to the end of September have been canceled for weather reasons, we will extend your gift voucher once for one year, i.e. until the end of September 2023.
– Your gift voucher is purchased on July 25, 2022, you can take your flight during the opening period, i.e. from July 25, 2022 to the end of September 2022 and from April 1, 2023 to July 25, 2023; and if 3 reservations (during these periods) have been canceled for weather reasons, we will extend your gift voucher once by one year, i.e. on July 25, 2024.
Article 10 Special conditions and characteristics of the service
Compte tenu de la spécificité de l’activité proposée très dépendante des conditions météorologiques il est expressément convenu et accepté par le Client acquéreur que le bénéficiaire du bon de commande doit être obligatoirement en mesure de se présenter plusieurs fois dans la saison, compte tenu du risque d’annulation et/ou de report des vols en fonction de la météo ;
The seller will therefore give priority to the beneficiary of said voucher residing near the place of flight, i.e. a geographical proximity of less than 100 km.
The day before the scheduled flight date, the beneficiary is contacted by the Company, based on the latest weather forecast (wind strength and direction) to specify:
– either the appointment time
– soit l’annulation du rendez-vous pour des raisons météo.

Néanmoins, le bénéficiaire du bon accepte expressément qu’un retard (éventuellement, même si cela est exceptionnel, de plusieurs heures) puisse intervenir sur l’heure de rendez-vous et demeure, en conséquence, disponible.
Otherwise, the voucher will be lost.
ARTICLE 11 Conditions d’annulation
The beneficiary can cancel his reservation at the latest 48 hours before the date on which the flight was to take place.
Consequently, in the event of absence or cancellation less than 48 hours before the flight date, the voucher will be lost, the amount of the voucher remaining acquired by the Company.
ARTICLE 12 Liability:
All our instructors are qualified, have liability insurance and recent equipment, meeting CE standards, and implement all possible safety measures in our activity.
Everything necessary is implemented to practice safely. In the event that an injury is caused by the practice of a tandem flight, the instructor's liability insurance would cover the damage caused.
The instructor reserves the right not to carry out the flight if he considers the weather conditions too dangerous or if he considers that the passenger is not fit.
In the event that the passenger is not fit for take-off, no refund will be granted. The passenger can nevertheless give their gift voucher to a loved one on the day of the flight.
For safety reasons, it is expressly agreed and accepted by the purchasing Customer and the Beneficiary of the voucher that the weight of the beneficiary of the gift voucher cannot exceed 100 kg.
ARTICLE 13 Complaints and mediation
If necessary, the Buyer may submit any complaint by contacting the company using the following contact details: contact@parapentedunedupyla.com, by sending an email.
Conformément aux dispositions des art. L. 611-1 à L. 616-3 du Code de la consommation, le consommateur est informé qu’il peut recourir à un médiateur de la consommation dans les conditions prévues par le titre Ier du livre VI du code de la consommation.
En cas d’échec de la demande de réclamation auprès du service client du Vendeur, ou en l’absence de réponse dans un délai de deux mois, le consommateur peut soumettre le différent à un médiateur, qui tentera en toute indépendance de rapprocher les parties en vue d’obtenir une solution amiable.
ARTICLE 14 Intellectual Property Rights
The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller.
No transfer of intellectual property rights is made through these T&Cs. Any total or partial reproduction, modification or use of these assets for any reason whatsoever is strictly prohibited.
ARTICLE 15 Force majeure
The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The seller shall notify the customer of the occurrence of such an event as soon as possible.
ARTICLE 16 Nullity and modification of the contract
If one of the provisions of this contract were to be cancelled, this nullity would not entail the nullity of the other provisions which will remain in force between the parties. Any contractual modification is only valid after a written agreement signed by the parties.
ARTICLE 17 Protection of personal data
Conformément au Règlement 2016/679 du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données, le Vendeur met en place un traitement de données personnelles qui a pour finalité la vente et la livraison de produits et services définis au présent contrat.
Aucune décision automatisée ou profilage n’est mis en œuvre au travers du processus de commande.
Article 18 Applicable law and clauses
All clauses appearing in these general conditions of sale, as well as all purchase and sale transactions referred to therein, will be subject to French law.
La nullité d’une clause contractuelle n’entraîne pas la nullité des présentes conditions générales de vente.
Article 1127-1 of the Civil Code
L’auteur d’une offre reste engagé par elle tant qu’elle est accessible par voie électronique de son fait.
L. 411-1 Consumer Code
